ListLift provides photorealistic property marketing media services, including but not limited to: photorealistic stills, cinematic marketing video, full campaign asset production, and retainer-based media production ("Services").
Engagement of our Services is subject to a separate project brief and, where applicable, a service agreement or statement of work. These Terms apply to all such engagements unless otherwise agreed in writing.
8. Client-Submitted Content
To deliver our Services, you may submit source material including CGI renders, 3D visuals, architectural drawings, photography, and related project documentation ("Client Content").
By submitting Client Content, you confirm that:
- You own or have the necessary rights and licences to submit the material;
- The material does not infringe the intellectual property rights of any third party;
- The material does not contain anything unlawful, defamatory, or harmful.
By using our website or services,You grant ListLift a limited, non-exclusive licence to use Client Content solely for the purpose of delivering the agreed Services. We will not use your Client Content for any other purpose without your written consent.
We will not be liable for any third-party claims arising from Client Content submitted by you. you acknowledge that such transfers may occur.
9. Intellectual Property
Our Content
All intellectual property rights in the Site and its content — including text, graphics, design, and code — are owned by or licensed to Storytailors Limited. All rights are reserved.
You may view and print content from the Site for personal, non-commercial reference only. You must not use any content from the Site for commercial purposes without our prior written permission.
Delivered Assets
Upon receipt of full payment for a project, ownership of the final delivered assets transfers to you. You may use those assets for any lawful commercial purpose without restriction, including web, social, print, and out-of-home advertising.
ListLift retains the right to display delivered work in our portfolio, on the Site, and in our marketing materials, unless you request otherwise in writing prior to project commencement.
Our Brand
You must not use the ListLift name, logo, or any associated trademarks without our prior written consent.
10. Confidentiality
Both parties agree to treat as confidential any non-public information disclosed in connection with a project engagement. We will not share your project materials, briefs, or business information with third parties except as necessary to deliver the Services, and only under appropriate confidentiality obligations.
11. Payment
Payment terms are set out in your project brief or service agreement. Where no specific terms are agreed:
- Payment is due within 14 days of invoice;
- We reserve the right to suspend delivery of Services where payment is overdue;
- Ownership of delivered assets does not transfer until full payment is received.
12. Limitation of Liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under Irish law.
Subject to the above, to the extent permitted by law:
- We exclude all implied conditions, warranties, and representations;
- We will not be liable for any indirect, consequential, or economic loss, including loss of profit, loss of business, or loss of opportunity;
- Our total liability to you in connection with any project shall not exceed the total fees paid by you for that project.
Use of the Site is at your own risk. The Site is provided on an "as is" and "as available" basis.
13. Third-Party Links
The Site may contain links to third-party websites for your information only. We do not endorse those websites and are not responsible for their content or practices. We will not be liable for any loss or damage arising from your use of third-party sites.
14. Viruses and Security
We do not guarantee that the Site is secure or free from bugs or viruses. You are responsible for your own virus protection. You must not introduce malicious code or attempt to interfere with the operation of the Site or our infrastructure.
15. Governing Law
